Labor & Employment Attorney - Defend Employers Against Complex Claims in California

Salary: Competitive, based on experience

Overview:

Join our legal team as a Labor & Employment Attorney and utilize your skills as a skilled advocate to defend employers against complex employment-related claims, particularly in California. Our ideal candidate will have a high “HQ” (Hospitality Quotient) and be able to provide strategic legal counsel and representation in all phases of employment litigation.

Responsibilities:

- Aggressive Defense: Provide strategic legal counsel and representation in all phases of employment litigation, including pre-litigation investigation, discovery, motion practice, trial preparation, and appeals.
- Proactive Legal Counsel: Advise management on a wide range of employment law issues, including wage and hour compliance, discrimination, harassment, wrongful termination, retaliation, and leave of absence laws.
- Policy Development and Compliance: Draft, review, and update employment policies and procedures to ensure compliance with federal, state, and local laws.
- Risk Mitigation: Conduct regular risk assessments and implement proactive measures to minimize legal exposure.
- Training and Education: Develop and deliver training programs to HR and management on employment law topics.
- Collaboration: Work closely with HR and other business units to provide practical legal advice and support.

Qualifications:

- Experience: Minimum of 8-10 years of experience practicing employment law, with a strong emphasis on defense work.
- Education: Juris Doctor degree from an accredited law school.
- Certifications: Admitted to practice law in California.
- Technical Knowledge: Deep understanding of California labor laws, including the California Labor Code, Fair Employment and Housing Act (FEHA), and Wage and Hour laws.
- Skills: Proven ability to handle complex employment litigation matters, including class actions and PAGA claims. Excellent legal research, writing, and oral advocacy skills. Strong attention to detail and ability to manage multiple deadlines. Ability to work independently and as part of a team.

Preferred Qualifications:

- Experience handling investigations of workplace misconduct.
- Knowledge of federal employment laws, including Title VII, the ADA, and the FMLA.
- Experience with alternative dispute resolution (ADR) processes.

Physical Requirements:

- Work Environment: Primarily office-based, involving prolonged periods of sitting at a desk.
- Computer Use: Frequent use of a computer for drafting documents, conducting research, and communicating via email.
- Visual Acuity: Must be able to read and interpret legal documents, computer screens, and printed materials.
- Manual Dexterity: Ability to use a keyboard, mouse, and other office equipment.
- Mobility: Occasional walking, standing, and reaching within the office environment.
