Washington, DC Organization: U.S. Department of Health and Human Services, Office of the General Counsel (OGC) Position: Attorney Advisor GS-11/12/13/14 Experience: 1-3 years of professional legal experience Location: Washington, DC (Telework option available) Salary Range: $82,764 - $181,216 Open Period: October 9, 2024 – October 18, 2024 Job Summary: - Join the Department of Health and Human Services (HHS) and make a difference in the lives of individuals across your community, state, and country. - HHS is the principal agency for protecting health in America. - As an Attorney Advisor in the Civil Rights Division (CRD), you will primarily advise on the enforcement and administration of the Health Insurance Portability and Accountability Act (HIPAA) regulations. - CRD provides legal counsel to the Secretary of HHS and the Office for Civil Rights (OCR), which enforces HIPAA, civil rights laws, conscience and religious freedom laws, and more. - HHS is committed to creating a diverse environment and is an equal opportunity employer. - Diversity, equity, and inclusion are core values at HHS. Duties: - Provide legal advice and services to OCR on issues related to the enforcement and administration of the HIPAA Privacy, Security, and Breach Notification Rules. - Serve as a principal player in the development of departmental policies, legislative and regulatory proposals, and special OCR initiatives to ensure the protection of health information. - Support OCR's enforcement of potential HIPAA violations by covered entities and business associates. - Review OCR documentation and work with regional civil rights offices involved in HIPAA investigations, settlement negotiations, and defending challenges to agency actions. - Assist the Department of Justice with cases brought in federal court. - Provide legal advice on the implementation of policy development and administrative rulemaking activities. - Advise on executive branch and legislative program initiatives affecting health privacy and cybersecurity. - Serve as an intra-Departmental and interagency advisor on matters related to health information privacy and security. Qualifications: - Juris Doctorate (J.D.) or LL.B from an accredited ABA law school. - Active bar status in good standing. - 1-3 years of professional legal experience. - Demonstrated interest in HIPAA regulations, health information privacy, and/or cybersecurity. - Administrative or federal court litigation experience preferred. - Familiarity with the Administrative Procedure Act or regulatory experience desirable. Conditions of Employment: - Must maintain active bar membership in good standing throughout employment. - Background security investigation and favorable adjudication required. - E-Verify participation and direct deposit required. - Financial disclosure statement and two-year trial period may be required. - Travel, transportation, and relocation expenses will not be paid. - Non-bargaining unit position. - Telework eligible.
