Staff Attorney

The Staff Attorney will serve as the legal counsel for the organization, providing guidance and representation on a variety of legal matters. The position requires a minimum of five years of experience in education-related law or similar fields, with a preference for candidates with experience in the public sector. The Staff Attorney will report to an assigned supervisor in the Legal Office and work in collaboration with various departments and school sites. The position is classified as Classified Confidential and is exempt from overtime pay.

The Staff Attorney will be responsible for providing advice and counsel on regulatory matters, including but not limited to responding to and representing the organization in various legal proceedings such as EEOC/DFEH charges, OCR complaints, and California Commission on Teacher Credentialing inquiries. They will also provide counsel to school sites and/or the Student Discipline Hearing panel on student discipline matters. Additionally, the Staff Attorney will advise and represent the organization in labor and employment issues, including drafting legal notices and representing the organization in hearings, arbitrations, mediations, and contract negotiations. They will also be responsible for drafting and reviewing contracts and agreements, providing proactive legal advice to various departments, and handling conflict of interest matters. Other duties include providing advice and counsel on Section 504, Public Records, and student records/FERPA, as well as representing the organization in civil litigation and administrative hearings.

The Staff Attorney will be expected to maintain confidentiality in all personnel matters and may have access to confidential information concerning employer-employee relations and negotiations. They will also be responsible for conducting investigations, preparing pleadings and briefs, and conducting legal research. The position requires strong communication skills, both written and oral, and the ability to work collaboratively and efficiently. The Staff Attorney must also have a strong understanding of government law, education law, labor law, affirmative action, and employment discrimination, as well as constitutional and administrative law.

To be considered for this position, candidates must meet certain prerequisites, including graduation from an accredited law school and five years of experience in education-related law or similar fields. They must also be eligible for membership in the State Bar of California and admission to practice before the United States District Court for the Northern District of California. A valid California Driver's License may also be required.

The pre-employment process for this position will include fingerprinting, tuberculosis testing, and other employment clearances. The working conditions for the Staff Attorney include a fast-paced environment with constant interruptions and the need to drive to conduct work. The physical requirements include sitting or standing for extended periods of time, lifting up to 30 pounds, and dexterity of hands and fingers while using a computer.
